Class and Collective Actions
BE CAUSE targets diffuse stakeholders (associations, committees, groups of interest) to facilitate the promotion of class and collective actions, particularly in antitrust, health, environmental and product liability litigation.
Class and collective actions are new and uncommon in Italy.
Litigation Funds are an extraordinary tool to establish also in Italy class actions allowing individual parties suffering damages form the same event to join forces in situations where acting individually is too risky given the substantial economic resources and negotiating strength of the incumbent.
CLASS AND COLLECTIVE ACTION
BE CAUSE through the disposal of financial resources and by serving as an aggregator:
- enables the promotion and development of class actions
- covers all litigation costs and bears the risk of losing the case
- allow more efficient and coordinated management of the actions of individual claimants
- create greater bargaining power in each phase of the claim (including when negotiating a settlement)
